Federal law prohibits certain persons from shipping, transporting, possessing, or receiving firearms or ammunition including any person who:

• Has been convicted of a crime punishable by a term of imprisonment exceeding one year;

•  is an unlawful user of, or addicted to, any controlled substance; THIS INCLUDES THOSE THAT HAVE A MAINE MEDICAL MARIJUANA CARD
• Has been adjudicated as a mental defective or committed to a mental institution;

•  is an alien who has been admitted to the United States under a nonimmigrant visa (with certain exceptions);
• Has been discharged from the armed Forces under dishonorable conditions;
• Has renounced United States citizenship;
•  is subject to a qualifying protective order;
• Has been convicted of a misdemeanor crime of domestic violence.
Further, Federal law prohibits the shipment,transportation,or receipt of firearms or ammunition by any person who is under indictment for a crime punishable by a term of imprisonment exceeding one year.
Federal law also prohibits, with certain exceptions, the possession of handguns by any person under the age of 18.


Buying a gun for someone who is prohibited by law from possessing one or for someone who does not want his or her name associated with the transaction is a "straw purchase."

- An illegal firearm purchase (straw purchase) is a federal crime.
- An illegal firearm purchase can bring a felony conviction sentence of ten years in jail and a fine of up to $250,000.
- Buying a gun for someone who can't can cost you your good name and land you in big trouble.

Never buy a gun for someone who is unwilling or unable to do so.

You can gift a gun as long as they are legally able to own a gun. If anything happens the ATF will be knocking on your door no matter if you put it in his/her name later or someone else owns it. Some think that registering a gun to someone later on removes their name from gun ownership. The first owner (you) will always be the first one the ATF call when tracing a gun.

Some think that since they were denied 10 years ago that something will change. Sorry that is NOT the case. I have heard this story before. After the background check is denied they tell me the story on how they were denied many years ago and they figured they would try again. My advise DON'T TRY IT!

FYI some are getting denied due to unsettled tickets in other states or past charges that were not restricting gun purchases in the past but with new law changes will cause them to be denied instead of being delayed.

DELAYED: If the background check status is delayed.

You MUST pay for the firearm in FULL or the firearm will not be held.

If we get a proceed answer on your background check we will call you to come pick up the firearm. If we do not receive an answer see below.

We use the Brady Transfer Date for delayed background check with no response.

A Federal Firearms Licensee (FFL) will receive the following instructions when a call is transferred from the National Instant Criminal Background Check System (NICS) Contracted Call Center to the FBI Criminal Justice Information Services Division’s NICS Section for a transaction resulting in a delay:

“—NTN— is delayed while the NICS continues its research. If you do not receive a response from us, the Brady Law does not prohibit you from transferring the firearm on ___ day/date ___.”

We have the right transfer on the Brady Transfer date or not to transfer at all. - If the FFL has not received a final determination from the NICS when the Brady transfer date arrives, it is within the FFL’s discretion whether or not to transfer the firearm (if state law permits the transfer). If the FFL transfers the firearm, the FFL must check “no resolution was provided within three business days” on line 21d of the ATF Form 4473.

- Customers under 21 automatically will be delayed.
- 21 and older: Some customers get delayed when it is their first firearm purchase, some are delayed randomly, and some get delayed every time, and many never get delayed. The results are the same whether the background check is called in or done online.

LD 2238: "An Act to Address Gun Violence in Maine by Requiring a Waiting Period for Certain Firearm Purchases"

LD 2238 would require a 72-hour waiting period after the purchase of a firearm.

A 72-hour waiting period between the purchase of a firearm and the transfer from a seller to a buyer will come into effect sometime in July. We do not know the exact date right now.

Expect to have to make two trips when enacted unless it is reversed. SEE OUR POLICY RELATED TO THIS LAW AT THE TOP OF THIS PAGE.

RIGHT TO REFUSE SALE:
We have the right to refuse to sell to anyone. Some of the reasons we may refuse to sell to a customer. We are here to serve and protect the public from those that should not have firearms.
A customer that
- Is a suspected Straw purchaser
- Appears to be under the influence of drugs or smells of drugs.
- Appears to be a danger to themselves or others
- Appears nervous or angry (Even if someone shows extreme anger when the background check status is delayed. We have to wonder if they are planning something.)
- Has a medical marijuana card that is visible to us.
- Talks about killing or conducting violence.
- Does not have the knowledge, experience, mental capacity, or dexterity to handle a weapon. We would do this to protect them from hurting themselves or others.
- Has someone else sitting outside in a car that looks suspicious or could have out of state plates when the firearm can only be sold to Maine residents. Straw purchase? We do have camera surveillance systems.
We may not give you a reason as to why we refused the sale. We are not required to give a reason. We will not refuse a sale due to gender, race, or sexual preference.

Warranties:  

Allsport Performance Inc. is not a warranty repair station. We make no express or implied warranty whatsoever with respect to any merchandise, including but not limited to the implied warranties of merchantability and fitness foe a particular purpose. The only warranties provided are provided by the manufacturers and are as contained in each manufacturer's package. You must contact the manufacturer if you have an issue. If you have a firearm with an issue and it needs to be sent back to the factory tell the manufacturer you want a call tag. They will send you a shipping label free of change and you can send the firearm back to them (no need to go through a dealer). Once repaired they will send the firearm directly back to you. The manufacturers like dealing with the customer directly. They are able to talk to the customer about the issue they are having so the problem can be resolved. I have tried to call the manufacturers for customers in the past and I end up handing the phone to the customer and they deal with them directly.

All used firearms or other used merchandise is inspected and cleaned by our staff to insure its "safe" and dependable functionality. All used merchandise is sold "as is" and no warranties are made. Purchasers of used firearms are urged to contact the manufacture for a firearm owners manual for such firearm. We recommend all guns be checked by a professional gunsmith before firing. Firearms Mark up:

We offer a low profit margin on firearms. While other shops say they mark up firearms a certain percentage across the board we other fixed profit margins. We mark up our firearms from $25 to $50 dollars in most cases with most middle of the road guns marked up $40. That is roughly 20% on on the lowest priced items and as low as 5% on more expensive firearms.  Yes our profit margin goes down as the price of the firearm goes up.

PRICE INCREASES:

On January 1st distributors and manufacturers adjust their prices for the new year. I have seen a 1%-10% increase in prices on January 1st. Sometimes it is even more than that. I have never seen a price decrease. When there is a presidential election prices usually increase, sales / deals end, and availability of firearms, magazines and ammo decreases. I always encourage customers to buy if they can prior to January 1st. If there are hard to get guns that you want they will only get hard to get on January 1st and even worse during a presidential election year. Manufacturers shut down near the end of the year and distributors start reducing stock. They usually do not start production back up until February and guns do not start becoming available until mid March. This is true for every year I have been doing this.

Firearms MAP Pricing:

MAP Pricing = Minimum Advertised Pricing YOU WILL SEE THIS ON THE WEBSITE AS THE RETAIL PRICE ON FIREARMS. There will not be a CASH price shown. This is the lowest price the manufacturer allows a dealer to put on a gun. The dealer is allowed to sell it for less which we do in most cases. However the only way to know what the selling price would be is to ask us. Sometimes it is just a little less than MAP plus a cash discount off that or some MAP prices are quite high and you could receive good savings of the MAP price plus a cash discount off that.

IN STORE Special Orders:

Special orders are only offered IF the firearm wanted is IN STOCK at my supplier. I will not take pre payment for something that is out of stock at my supplier (NO BACK ORDERS). If paying cash the item must be paid in full before we order it. If paying by credit or debit the item must be paid in full before we order it. This policy is due to guns that have been ordered and never picked up or guns that have sat here for a very long time before being picked up with only a small portion of money down. Returns on special orders (non firearms) will be subject to  25% restocking charge. We do offer a cash price on special orders. MOST ORDERED FIREARMS WILL ARRIVE IN 3-7 DAYS. Ordered firearms should be picked up within 7 day of us receiving it.

BY PHONE Special Orders:  

If ordering a firearm by phone you must pay by credit card or via Paypal in full before we order it. In order to get a cash price on an ordered firearm by phone you must send a USPS money order via mail prior to us ordering the firearm. We do not accept personal checks. Returns on special orders (non firearms) will be subject to  25% restocking charge. We do not offer a cash price on special orders over the phone. MOST ORDERED FIREARMS WILL ARRIVE IN 3-7 DAYS. Firearms Transfers:

This FEE is for firearms purchased online or private party (person to person) transfers.

MULTIPLE HANDGUN TRANSFER FEE: There is an additional fee for the transfer of more that one handgun within 5 working days. PLEASE SCROLL DOWN FOR MORE INFORMATION ON TRANSFERS.

Investigating the Purchase of Multiple Firearms - Under the 1968 Gun Control Act, FFLs are required to report multiple sales of handguns to the same purchaser. Have you ever thought about buying a set of His and Hers pistols? Or maybe you go into a gun store to buy a handgun, and you see a deal on another one that you just can’t pass up. There’s nothing wrong with a thoughtful gift or getting a deal, but there is something important you must know. The sale or disposition of two or more handguns must be reported to the ATF and local authorities if they occur at the same time, or within five consecutive business days. The same goes for certain rifles sold in southern border states. This is because the ATF keeps a close watch on the transfer of multiple firearms that take place in a short period of time. This is to prevent weapons trafficking, unlicensed firearms businesses, and to protect public safety. Whatever the reason may be, just know if you find yourself in this situation, the ATF and the local police may want to inspect your collection, and you need to know what to do.

LD 2224 will be in effect soon! It will be a Class C the crime of intentionally, knowingly or recklessly selling or transferring a firearm to a person who is prohibited from owning, possessing or having under that person's control a firearm. Establishes a Class C crime for a seller who is not a federally licensed firearms dealer to complete a transaction unless the seller facilitates the transaction through a federally licensed firearms dealer and the dealer performs a background check of the seller by using the Federal Bureau of Investigation, National Instant Criminal Background Check System.

Ammunition:  

You must be 18 years old to purchase rifle or shotgun ammunition and must be over 21 to purchase pistol ammunition. ID is required.

Knives:  

You will need to be 18 years old to purchase a knife and ID is required.

Handguns:

You will need to be 21 years old or older and a Maine resident and US Citizen to purchase.

Long guns:

You will need to be 18 years old or older and a Maine resident and US Citizen to purchase.

Receivers:

You will need to be 21 years old or older and a Maine resident and US Citizen to purchase.

Rifle and pistol Magazines:

We only sell rifle or pistol magazines with capacities over 10rds to Maine residents ONLY.

Buying / Trade ins:  

For safety purposes and resale value we do not take any guns in for resale that have been modified. Such as trigger upgrades and other internal or external upgrade to improve the mechanical performance of the gun.
TRADING IN A FIREARM? Please note when considering trading in a firearm we do not take in every firearm that walks in the door. It depends on what we have in stock, if it is a hard to sell model, a firearm that is known to have problems or a recall, the time of year, and the condition of the firearm. Firearms that we are highly likely to take in are old, antique, vintage, or military firearms. Older lever action rifles. Older Colt, Ruger or Smith revolvers. Pre 64 firearms. We do take newer production firearms but it depends on what you have. WE DO NOT BUY modern muzzleloaders, reproduction firearms, sporterized firearms, firearms with upgraded or modified triggers, AR15's or AR10's that are not factory made (No individually made, locally or non locally made custom AR's), handguns with stippled or modified frames, firearms with non factory Cerakoted or Duracoated finish, Jennings firearms, Bryco firearms, Benelli firearms, Stoeger firearms, reloaded ammunition, used optics or bows please*** (We only make exceptions when buying estate collections) When dealing with buying estate collections we will buy them all.

We also purchase seized firearms from evidence rooms of law enforcement agencies. This helps the departments to buy needed gear and equipment for their officers.


Why sell to a dealer?

We have an increased amount ATF firearm traces due to firearms being sold private party. The crimes are very rarely committed by the person that purchased the firearm new or used and completed a 4473 and background check. It is when these firearms are sold private party without a background check.  Often these firearms are purchased by straw purchasers. Straw purchasers (this happens to dealers as well) are buying for someone that is not legally able to purchase the firearm themselves through a dealer or if you saw the actual person buying the firearm you may have second thoughts. They may have the profile of a gang member or drug dealer. I have heard stories of someone selling a gun to an innocent looking man or woman and after the sale is complete the firearm is handed over to someone else less than innocent looking and they stuff the gun down their pants and take off. Most of the firearms involved in crimes are handguns but some long guns are used. For 2017 the amount of Maine ATF traces per firearm type are as follows: Pistols - 188, Rifles - 94, Shotguns - 55, Revolvers - 42, Comb - 3, Derringers - 3, Other - 2. If you sell private party you do have an option to conduct a FFL Transfer through a dealer. The person making the purchase will have to fill out a 4473 and go through a background check. FFL transfer fees are typically 20-25 dollars per firearm. I personally do not sell any firearms private party.

 

Holding Firearms /Layaway:  

We will not hold any firearm until a cash deposit it made on the firearm. (we will not hold firearms by phone) We will not hold a firearm more than 7 days. If it is longer than 7 days then you would need to go through our layaway plan. PLEASE SEE OUR LAYAWAY POLICY or see the link on our home page.

If you have a long drive to get here and you want a firearm held for the length of time it will take you to get here we can do that. Call, message through Facebook, or email us. We will not hold a firearm more than 4 hours. 4 hours should be sufficient for travel from most parts of the state. We will not take pre payments by phone or credit card holds by phone. The firearm will not be held until I actual reply to your message and confirm.

Firearms SOLD OUT / COMING SOON:

If a firearm shows SOLD OUT or COMING SOON on the website we will be restocking the firearm as soon as one is available or  when it is the season to restock the firearm. If the firearm shows SOLD OUT or COMING SOON go to our GUNS COMING SOON PAGE on this website to see if the firearm has been ordered for restock. There is a list of firearms in shipment to us. These firearms are first come first serve. No pre payments, cash or credit card holds will be accepted. It does not hurt to ask if you can special order a firearm. It might be we just chose not to restock.

Do you have a call list of specific hard to get guns? No I have no call lists please keep checking the website.

 

Pawn:

We are not a Pawn Shop but we do purchase firearms.

Firearms Storage:  

We do not offer this service to out of state residents. FYI If you drop any handgun off to a dealer in Maine you will not be able to get it back (if you are not a Maine resident) without sending it back to an FFL in your state. At that point a transfer would have to be performed. We can only sell or transfer handguns to state of Maine residents. In order to get your firearm back you would have to go through a background check. Background checks can only be legally done on handguns for Maine residents. Long guns are ok to perform storage and can be reclaimed only if the firearm is legal in your state of residence. We do not perform this service.

Out of State Online Firearms Sales:

We only sell firearms listed on this website within the state of Maine. We do list many used firearms on Gun Broker that do ship out of state.

Acceptable Criteria

   The item must be the identical brand, color, model number, and in new condition.
   The price and item must appear in a local competitor’s website.
   The local competitor must be in the same market.
   The proximity of a “local” competitor will be at the store manager’s discretion.
The competitor must have a retail location with at least equal inventory to our own (400+ firearms)
   The competitor must be open a minimum of 44 hours which proves they are operating full time 5 or 6 days a week. (same as us)


Unacceptable Criteria

   Ads when the actual price cannot be determined
   Competitor ads from outside of the store’s local market
   It is the store’s general manager’s discretion as to what defines a local market
   Items listed by the other retailer as Sale, Clearance, Closeout, Liquidation, Special Hour/ Flash/ Limited Quantity, or Going Out of Business
   Service such as delivery or handling charges & installation prices
   Misprinted local competitor ads & incorrect internet pricing
   3rd party internet seller pricing (e.g. eBay, Amazon or Walmart Marketplace, GunBroker)
Items that are not in stock at the competitors' location
Items not listed on the competitors' website
Firearms that are listed below MAP pricing on a competitors' website
Website listings that do not list the condition of the firearm
Any online retailers
Local retailer websites that do not reflect firearms actually in stock at their location. Such as buy and ship to store.
Box stores such as Walmart, or Cabela's
