LD. 2224 An Act to Strengthen Public Safety by Improving Maine's Firearm Laws and Mental Health System. This will require background checks on ALL advertised firearms sales (such as Uncle Henry's or other online or newspaper ads). See the FFL TRANSFERS PAGE for more info. What is a Person to Person Private Party Sale Transfer? This is when dealer conducts an FFL Transfer between a private party wants to sell a firearm (seller) to another private party (buyer). The dealer will conduct a background check on the buyer. This will be required for all advertised sales in Maine starting August 9th 2024.
TRANSFER FEES: (Fees do not apply to firearms and receivers purchased from us) This is a lower rate than most shops charge. Some charge up to 70 dollars.

TRANSFER FEE: For Private Sale between two parties: $25.00 Credit of Debit ($20.00 CASH PRICE) per firearm / frame / receiver
DENIED FEE: If a firearm transfer takes place and the buyer is Denied on the background check : $25.00 Credit of Debit ($20.00 CASH PRICE) per firearm / frame / receiver
Remember the firearm has to be logged in before the background check takes place. If the buyer is denied I will have to conduct a background check on you (the owner) so you can take possession of your firearm(s).
MULTIPLE HANDGUN TRANSFER CHARGE: (For online purchases or private sale between two parties totalling 2 handguns or more within 5 consecutive business days) This charge is for a separate form that needs to be emailed to the ATF by end of business day and mailed to the Penobscot County Sheriffs Office by the next day. : $25.00 Crdit or Debit ($20.00 CASH PRICE) THIS IS IN ADDITION TO THE TRANSFER FEE SHOWN ABOVE. (Not charged if you purchase firearms from us)
STORAGE FEE: Due to limited storage space, firearms left on site for greater than 60 days will be charged an additional $20.00 Credit or Debit ($15.00 CASH PRICE) per month thereafter per firearm / frame / receiver.

PRIVATE SALE TRANSFERS (PERSON TO PERSON):
LD 2224 will be in effect soon! It will be a Class C the crime of intentionally, knowingly or recklessly selling or transferring a firearm to a person who is prohibited from owning, possessing or having under that person's control a firearm. Establishes a Class C crime for a seller who is not a federally licensed firearms dealer to complete a transaction unless the seller facilitates the transaction through a federally licensed firearms dealer and the dealer performs a background check of the seller by using the Federal Bureau of Investigation, National Instant Criminal Background Check System.

WHAT WILL WE NOT ACCEPT FOR TRANSFER?
- We do not accept transfers of Privately made firearms (PMFs), which have become informally known as “ghost guns”. Those firearms would have to be serialized by us and that is nothing we want to deal with at this time.
- We do not accept NFA items or Class 3 firearms.
Peace of Mind Transfer. You can conduct a private sale while involving an FFL with the firearm being signed onto the books of the FFL. A background check will be completed on the buyer of the firearms. At my shop, I call this a “Peace of Mind Transfer” to reassure the buyer that the gun isn’t stolen and to let the seller know that they aren’t selling the gun to a felon.
I will say form a dealers stand point that has to conduct many ATF Traces a year sometimes more than one in a week handguns being sold private party is the number one firearm I conduct traces on. I don't know how many people have been visited or questioned by the ATF about a firearms sales but once it happens to you I think you might change your mind about selling a handgun private party without a background check. I am all about 2nd amendment rights but this is something first hand I deal with and I know can be a problem. I really don't want to sell Hi Point's (may not sell again), Jimenez (Don't sell anymore), and other cheaper handguns as those seem to always come back to haunt me. Taurus, Cheaper Ruger's, and some Glock's are some of the others that are popular on the traces that I am required to do. Some traces are on firearms I sold 10 or more years ago.
If you plan to sell a firearm you own to another person you have the option to do an FFL transfer. The firearm to be transferred must be legal to own here in Maine! If you are not sure please check state laws before selling your firearm. You are not required to be a Maine resident for us to transfer a firearm to a Maine resident. You must be a US citizen. You must have a valid drivers license or state id with your current physical address. If your drivers license or id does not have your current physical address you must have a valid vehicle registration, concealed carry permit, or hunting license that has your current physical address on it (not expired). We do not offer transfers for non residents of Maine or Non US citizens so make sure the person that is buying the gun is a Maine resident and US citizen.
How the process works:
- Make arrangements with the buyer of the firearm. Tell them you want to meet them here.
- Make sure both of you have the proper valid photo identification and vaild government issued proof of address (if not on your photo id) with you.
- You should make a bill of sale prior to coming to the shop.
- When you arrive I will log the firearm into my book.
- I will have the buyer fill out a 4473 and process the background check.
- Once the background check is complete and as long as the buyer passes the background check (some maybe delayed) you may complete the sale and the firearm will be logged out of our book to the new owner. Remember also there is a 72 hour waiting period taking effect on August 9th 2024.
- There is no need to make an appointment with us.

DELAYED OR DENIED STATUS:
PLEASE BE ADVISED YOU COULD BE DELAYED and not be able to pick your firearm up the same day. Customers under 21 automatically will be delayed. 21 and older: Some customers get delayed when it is their first firearm purchase, some are delayed randomly, and some get delayed everytime, and many never get delayed. The results are the same whether the background check is called in or done online.

We use the Brady Transfer Date for delayed background check with no response.
A Federal Firearms Licensee (FFL) will receive the following instructions when a call is transferred from the National Instant Criminal Background Check System (NICS) Contracted Call Center to the FBI Criminal Justice Information Services Division’s NICS Section for a transaction resulting in a delay:
“—NTN— is delayed while the NICS continues its research. If you do not receive a response from us, the Brady Law does not prohibit you from transferring the firearm on ___ day/date ___.”
We have the right transfer on the Brady Transfer date or not to transfer at all. - If the FFL has not received a final determination from the NICS when the Brady transfer date arrives, it is within the FFL’s discretion whether or not to transfer the firearm (if state law permits the transfer). If the FFL transfers the firearm, the FFL must check “no resolution was provided within three business days” on line 21d of the ATF Form 4473.

RIGHT TO REFUSE SALE:
We have the right to refuse to sell or transfer to anyone. Some of the reasons we may refuse to sell to a customer. We are here to serve and protect the public from those that should not have firearms.
A customer that
- Is a suspected Straw purchaser
- Appears to be under the influence of drugs or smells of drugs.
- Appears to be a danger to themselves or others
- Appears nervous or angry (Even if someone shows extreme anger when the background check status is delayed. We have to wonder if they are planning something.)
- Has a medical marijuana card that is visible to us.
- Talks about killing or conducting violence.
- Does not have the knowledge, experience, mental capacity, or dexterity to handle a weapon. We would do this to protect them from hurting themselves or others.
- Has someone else sitting outside in a car that looks suspicious or could have out of state plates when the firearm can only be sold to Maine residents. Straw purchase? We do have camera surveillance systems.
We may not give you a reason as to why we refused the sale. We are not required to give a reason. We will not refuse a sale due to gender, race, or sexual preference.
ATTN: Maine law requires you to notify the Secretary of State within 30 days of any change in your name or address.
